Privacy Notice 

This notice is provided pursuant to Article 13 of Legislative Decree 196/2003, the “Personal Data Protection Code” (the “Code”), and Regulation (EU) 2016/679, the “General Data Protection Regulation” (the “GDPR”), to users who interact exclusively with the web services of the Icom Srl website and not with other websites accessible via links.

Data Controller

The Data Controller is ICOM S.r.l., headquartered in Lanciano, Via 1 Località Cerratina.

Purpose of Processing

Icom Srl processes personal data strictly within the limits necessary to perform its institutional functions. Specifically regarding the company’s website, users are informed that only personal data related to navigation within the website will be collected (browsing data and data voluntarily provided by the user). No data derived from the web service will be communicated or disseminated; such data will be used exclusively for communications related to the website and its contents.

Types of Data Processed

The web services offered through the company website provide informational content and, at times, interactive features. Merely browsing the website does not require the provision of personal data, except for data automatically collected as described below:

Browsing Data

The IT systems and software procedures used to operate the website collect, during normal browsing, certain personal data whose transmission is implicit in the use of Internet communication protocols. These data are not collected to identify users, but by their nature could, through processing and association with data held by third parties, allow identification. Such data include IP addresses or domain names of the computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of requested resources, the time of the request, the method used to submit the request to the server, the size of the file returned in response, the numerical code indicating the server response status (successful outcome, error, etc.), and other parameters relating to the user’s operating system and IT environment. These data are used solely to obtain anonymous statistical information on website usage and could be used, upon request of the competent Authorities, exclusively for investigations or judicial purposes in compliance with applicable laws.

Cookies

Cookies are small text files sent by the website visited by the user to the user’s device (usually to the browser), where they are stored so that the device can be recognized during subsequent visits. At each subsequent visit, cookies are resent from the user’s device to the website.

Cookies may be installed not only by the website operator (first-party cookies), but also by third-party websites that install cookies through the first site (third-party cookies) and are able to recognize them. This occurs because the visited website may contain elements (images, maps, sounds, links to pages on other domains, etc.) hosted on servers other than the website visited.

Under the Provision issued by the Italian Data Protection Authority on 8 May 2014, “Simplified Arrangements to Provide Information and Obtain Consent Regarding Cookies” (the “Provision”), obligations regarding information and, where applicable, consent for third-party cookies fall upon those third parties. The website operator, as a technical intermediary between third parties and users, is required to include updated links to third-party privacy notices and consent forms within the extended information notice.

Based on their purpose, cookies are classified as technical cookies or profiling cookies.

Technical cookies are installed solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service” (Art. 122(1) of Legislative Decree 196/2003).

They are typically used to enable efficient navigation between pages, store user preferences, save information regarding user configurations, perform user authentication, etc.

Technical cookies include browsing cookies, used to store data useful for normal website navigation and use (e.g., remembering the preferred page size in a list), and functional cookies, which allow the website to remember user selections to optimize functionality (e.g., remembering country selection or persistent login status).

According to Art. 122(1) of the Privacy Code, technical cookies do not require user consent.

Analytics cookies are treated as technical cookies (and therefore do not require user consent), provided they are created and used directly by the first-party site operator (without third-party involvement) for optimization purposes to collect aggregated information on the number of users and how they visit the site; likewise for analytics cookies created by third parties but used by the first-party site solely for statistical purposes, provided that measures are adopted to reduce their ability to identify users (e.g., masking significant portions of the IP address).

Profiling cookies are used to track user navigation, analyze behavior for marketing purposes, and create profiles based on preferences, habits, and choices in order to send targeted advertising aligned with the user’s online interests.

Cookies may also be distinguished by duration: persistent cookies, which remain stored until expiration unless removed by the user, and session cookies, which are not stored persistently and disappear when the browser is closed.

This website uses technical cookies installed by the site itself to monitor operation and enable efficient navigation. These cookies are strictly necessary for the proper functioning of the site and for enabling access to content and services requested by the user.

Under Art. 122 of the Privacy Code and the Italian Data Protection Authority’s Provision of 8 May 2014, essential technical cookies and third-party analytics cookies (treated as technical when used directly by the site operator to collect aggregated statistics) may be installed without requiring user consent, provided that the information obligations under Article 13 of Legislative Decree 196/2003 and Article 13 of the GDPR are fulfilled.

Methods of Data Processing

Personal data are mainly processed using automated electronic tools for the time strictly necessary to achieve the purposes for which they were collected, and in accordance with the principles of lawfulness, fairness, non-excessiveness, and relevance established by applicable privacy laws.

Data Circulation Scope

Processing related to the web services of this website takes place at the aforementioned headquarters of Icom Srl and is carried out solely by technical staff responsible for processing operations or by authorized personnel performing occasional maintenance. No data derived from the web service is communicated or disseminated.

Data Retention

Browsing log data will be retained by the Data Controller for approximately 7 days.

Additionally, data you provide will be retained only for the period necessary to comply with legal obligations, unless further retention is required to establish, exercise, or defend a legal claim, or to comply with additional legal obligations or orders from Authorities.

Data Subjects’ Rights

Individuals whose personal data are processed (“data subjects”) have the right to exercise their rights within the limits and according to the procedures established by applicable privacy laws.

With regard to your personal data, you may request from Icom Srl:

  • Access: confirmation of whether data concerning you are being processed, further details on the information in this notice, and receipt of the data themselves, within reasonable limits.

  • Rectification: correction or updating of inaccurate or incomplete data.

  • Erasure: deletion of your data where no longer necessary for the intended purposes, where no disputes or claims exist, in the event of consent withdrawal or objection, in cases of unlawful processing, or where required by law.

  • Restriction: limitation of processing under conditions set out in Article 18 GDPR; in this case, your data will not be processed except for storage, unless otherwise permitted under paragraph 2 of the same article.

  • Objection: objection at any time to processing based on legitimate interest, unless compelling legitimate grounds override yours (e.g., legal defense).

  • Portability: receipt of your data in a structured, commonly used, machine-readable format, or transmission to another controller indicated by you.

You are also entitled to lodge a complaint with the Supervisory Authority, which in Italy is the Italian Data Protection Authority (“Garante per la Protezione dei Dati Personali”).

Changes to this Notice

New regulations, as well as the ongoing review and improvement of user services, may make it necessary to update or modify the terms of this notice. Consequently, this document may change over time. You are therefore encouraged to consult this page periodically.
